How Convenient… Menendez Donor Reveals Lobbying Effort Four Years Later

- March 28, 2013

THE COMPANY CONTROLLED BY MENENDEZ DONOR SALOMON MELGEN RETROACTIVELY DISCLOSED LOBBYING ACTIVITY SINCE 2009

“A Company Controlled By The Democratic Donor In The Middle Of The Robert Menendez Controversy This Week Revealed That It Spent As Much As $60,000 On Previously Undisclosed Lobbying.” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)

  • “Melgen’s Lawyers Had Claimed He Never Hired A Lobbyist For Himself Or His Business Interests And There Were No Mandatory Reports On Record Detailing Lobbying By Vitreo-Retinal Consultants — Until Now.” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico,3/27/13)

  • Lobbying Activity Is Required To Be Disclosed Within 45 Days Of Entering Into A Lobbying Contract. “Anyone who qualifies as a lobbyist is required to disclose their lobbying work — and roughly how much they’re being paid for it — within 45 days of making a ‘lobbying contact’ with more than one federal official, according to the Lobbying Disclosure Act. Those who ‘knowingly’ violate it are subject to a maximum fine of $200,000.” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)

MELGEN HAS EMPLOYED A LOBBYIST AND THE HELP OF MENENDEZ TO COMBAT GOVERNMENT CHARGES THAT HE OVERBILLED MEDICARE BY $8.9 MILLION

Democrat Donor Salomon Melgen Has Been Fighting The Federal Government For Charges That His Company, Vitreo-Retinal Consultants, Overbilled Medicare By $8.9 Million. “Salomon Melgen, a wealthy South Florida ophthalmologist and investor, has been fighting the federal government’s 2008 finding that his eye care company — Vitreo-Retinal Consultants — overbilled Medicare by $8.9 million. And he’s gotten help in that effort from his close friend Menendez, a Democratic senator from New Jersey.” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)

  • Melgen Employed The Lobbying Firm Arnold & Porter To Lobbying The Senate In 2009 For “Issues Related To Medicare Reimbursement.” “Paperwork filed Monday indicates that Alan Reider, a partner at the powerful law and lobbying firm Arnold & Porter, started lobbying the Senate in June 2009 for ‘Vitreo-Retinal Consultants Eye Center’ on ‘issues related to Medicare reimbursement.’” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)

  • Since 2009, Menendez Raised Concerns With Top Federal Health-Care Officials Twice In Recent Years About Their Charges Against Melgen. “Sen. Robert Menendez raised concerns with top federal health-care officials twice in recent years about their finding that a Florida eye doctor — a close friend and major campaign donor — had overbilled the government by $8.9 million for care at his clinic, Menendez aides said Wednesday. Menendez (D-N.J.) initially contacted federal officials in 2009 about the government’s audit of Salomon Melgen, complaining to the director overseeing Medicare payments that it was unfair to penalize the doctor because the billing rules were ambiguous, the aides said. Last year, in a meeting with the acting administrator of the agency in charge of Medicare and Medicaid, Menendez again questioned whether federal auditors had been fair in their assessment of Melgen’s billing for eye injections to treat macular degeneration, the senator’s aides said.” (Carol D. Leonnig and Jerry Markon, “Sen. Menendez Contacted Top Officials In Friends Medicare Dispute,” The Washington Post, 2/6/13)

“Over The Years, Melgen, His Companies And Family Contributed Nearly $1 Million To Menendez’s Campaigns And Committees That Could Help It.” “Over the years, Melgen, his companies and family contributed nearly $1 million to Menendez’s campaigns and committees that could help it. That includes $700,000 donated last year by Vitreo-Retinal Consultants to the since-renamed Majority PAC super PAC, which spent $582,500 supporting Menendez’s 2012 reelection campaign.”(Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)

  • “Federal Election Commission Records Also Show That Menendez’s Campaign, Which Has Benefited From Fundraisers Hosted By Melgen, In 2012 Received $1,000 From Reider And $7,000 From Arnold & Porter’s PAC.” (Tarini Parti and Kenneth P. Vogel, “Menendez Donor Reveals Lobbying Effort – 4 Years Late,” Politico, 3/27/13)
