THE PAY-TO-PLAY RELATIONSHIP BETWEEN THE CLINTON FOUNDATION AND CLINTON'S STATE DEPARTMENT HAS SNAPPED INTO FOCUS

DONALD TRUMP (CLIP): "It's called pay for play. Over and over and over people who donated to the Clinton Foundation or gave money to Bill Clinton got favorable treatment from Hillary Clinton's State Department." NBC'S ANDREA MITCHELL: "True or false?" PRESIDENT AND CEO OF THE CLINTON FOUNDATION DONNA SHALALA: "First of all there is no question there were phone calls made to get appointments for people but Mohammad Yunus, a Nobel Laureate. Melinda Gates? These are people any Secretary of State would have seen, courtesy appointments." MITCHELL: "What about business people?" SHALALA: "There were also business people. No question. I don't see evidence that there was policy decisions made as a result of that other than courtesy appointments. And people in public life are used to doing that kind of -- making courtesy appointments for people. I certainly did it as Secretary with requests from Republicans in Congress so I don't find it unusual. We have to be careful that it's not linked to policy decisions as opposed to simply seeing prominent people that ask for appointments." (MSNBC, 9/14/16)

Clinton Placed A Foundation Donor On A National Security Board With No Experience

As Secretary Of State, Clinton Appointed Rajiv Fernando To The International Security Board. "Today, the International Security Advisory Board (ISAB) met with Under Secretary Bill Burns, Under Secretary Ellen Tauscher, Special Advisor Robert Einhorn, Assistant Secretary Rose Gottemoeller, Assistant Secretary Andrew Shapiro and Acting Assistant Secretary Vann Van Diepen. … The meeting marked the first gathering of ISAB members appointed by Secretary Clinton. … Mr. Rajiv "Raj" Fernando, CEO and founder of Chopper Trading;" ("Meeting Of The International Security Advisory Board," U.S. State Department, 7/12/11)

Fernando Was Appointed To The State Department's International Security Advisory Board By Clinton's Chief Of Staff Cheryl Mills At Her "Insistence." "The newly released emails reveal that after ABC News started asking questions in August 2011, a State Department official who worked with the advisory board couldn't immediately come up with a justification for Fernando serving on the panel. His and other emails make repeated references to 'S'; ABC News has been told this is a common way to refer to the Secretary of State. 'The true answer is simply that S staff (Cheryl Mills) added him,' wrote Wade Boese, who was Chief of Staff for the Office of the Under Secretary of State for Arms Control and International Security, in an email to Mannina, the press aide. 'Raj was not on the list sent to S; he was added at their insistence.'" (Matthew Mosk, Brian Ross and Cho Park, "How Clinton Donor Got On Sensitive Intelligence Board," ABC News, 6/10/16)

"Hillary Clinton's State Department Aides Rushed A Top Secret Security Clearance For A Democratic Donor In Order To Place Him In A Government Position For Which He Was Not Qualified." (Sarah Westwood, "Clinton Aides Rushed Top Secret Clearance For Foundation Donor," The Washington Examiner, 6/16/16)

  • "Fernando's Lack Of Any Known Background In Nuclear Security Caught The Attention Of Several Board Members" And "Emails Show That Confusion Ensued Among The Career Government Officials Who Work With The Advisory Panel." "Fernando's lack of any known background in nuclear security caught the attention of several board members, and when ABC News first contacted the State Department in August 2011 seeking a copy of his resume, the emails show that confusion ensued among the career government officials who work with the advisory panel." (Matthew Mosk, Brian Ross and Cho Park, "How Clinton Donor Got On Sensitive Intelligence Board," ABC News, 6/10/16)
  • The Decision To Add Fernando To The Board With "No Obvious Experience In The Field…Appeared To Baffle The Department's Professional Staff." "Newly released State Department emails help reveal how a major Clinton Foundation donor was placed on a sensitive government intelligence advisory board even though he had no obvious experience in the field, a decision that appeared to baffle the department's professional staff." (Matthew Mosk, Brian Ross and Cho Park, "How Clinton Donor Got On Sensitive Intelligence Board," ABC News, 6/10/16)

Fernando's Appointment To The International Security Advisory Board Was Unusual, As A Seat On That Board Had "Not Traditionally Been Viewed As A Perk For Major Donors." "More than two dozen of the president's top fundraisers received ambassadorships during his first term, and dozens more have been placed in various key posts in his administration. Fernando's appointment stands out, however, because a seat on the International Security Advisory Board has not traditionally been viewed as a perk for major donors." THE FOUNDATION HAS BECOME A MAJOR HEADACHES FOR CLINTON'S 2016 RUN

The Calculus At The Clinton Foundation "Has Started To Change," As Clinton's Presidential Campaign Moved Forward And GCI "Became Embroiled In Political Controversy." " The calculus has started to change, foundation sources say, as the foundation raised a $250-million endowment to sustain itself during Hillary Clinton's campaign and potential presidency, and as CGI became embroiled in political controversy." (Ken Vogel, "Clinton Foundation Of Collision Course With Campaign," Politico, 1/28/16)

Dragging Her Painfully Off-Message, The Clintons Have Repeatedly Been Forced To Answer Questions About Ethical Concerns Surrounding The Foundation

In March, Clinton Was Pressed On Whether Or Not The Foundation Should Be "Wound Down" While She Runs For President For "Ethical" Reasons. MSNBC'S RACHEL MADDOW: "Let me ask you one-- last question. Which I'm asking in part because we're here in New York. Which is-- the headquarters of The Clinton Foundation, and The Clinton Global Initiative. Is there a case to be made, an ethical case to be made that The Clinton Foundation and the Global Initiative should essentially be wound down as a family foundation while you run for president? I ask that because I think about the-- the good works, the good charitable works that The Clinton Foundation has done. But the way that some of that work gets done is by soliciting donations from people in this country, from people around the world, from organizations around the world. I think it is not unreasonable to suspect that people may give donations to The Clinton Foundation hoping that they will favorably influence your opinion toward them, as a presidential candidate, or eventually as president if you're elected. Is there an ethical concern there that there should be essentially-- a split between you and your family, (COUGH) and-- and-- and this foundation, that has done good work? But now you're in a different position-- with regard to potential donors." CLINTON: "Well, look, I-- I think that-- the work that it's done has been extraordinary. And I give the credit to my husband and my daughter, because I haven't been involved-- for that long. And, you know, when I look at what they've accomplished, and what they've been able to amplify in terms of saving lives-- by getting the price of drugs for HIV/AIDS down in sub-Saharan Africa. It's quite astonishing. And I would hate to lose that creativity, that imagination, that-- extraordinary flexibility. So, I think the answer is transparency. And there is no doubt that there will be-- complete transparency about-- donations. But when you have hundreds of thousands of people who are donating-- as they do-- I think that-- the best-- answer for that is what we have been doing for the last several years. And that is-- to be transparent about it. And let-- you know, let voters and others make their judgment." (MSNBC's "The Rachel Maddow Show," 3/30/16)

In May, Bill Clinton Had To Deny That The Foundation Broke The Law When Asked By A Reporter At A Campaign Event. REPORTER: "Mr. President, regarding the Wall Street Journal report, did the CGI break the law? Regarding that report, do you have any response?" BILL CLINTON: "I-no, I haven't had a chance to read it carefully, but I think my Foundation whatever, is answering it." REPORTER: "So you deny that CGI broke the law in any way?" In June, Clinton Was Pressed On The Transparency Issues At The Clinton Foundation And Was Forced To Minimize The Disclosure Failures Of The Clinton Foundation. CNN'S ANDERSON COOPER: "Trump has said he is clearly going to focus on the Clinton Foundation. Last night said the Russians, Saudis, Chinese all gave money to the Foundation and got favorable treatment in return. The Foundation has raised huge sums of money for worthy causes, it's always not been transparent though. Tens of millions of dollars from come from a Canadian partnership so that the donors could remain secret, there was a large donation from Algeria not submitted to State Department for approval. If you are President, will your husband divest himself of any association with the Foundation?" CLINTON: "Well, Anderson, we will cross that bridge if and when we come to it, let me just try to set the record straight. We had absolutely overwhelming disclosure. Were there one or two instances that slipped through the cracks? Yes. But was the overwhelming amount of anything that anybody gave the Foundation disclosed, absolutely." (CNN, 6/8/16)

Clinton Has Defended The Foundation, Insisting There Weren't Conflicts Of Interest Clarifying It Is "All Smoke, No Fire." CNN'S ANDERSON COOPER: "Why was it okay for the Clinton Foundation to accept foreign donations when you were Secretary of State, but it wouldn't be okay when you are president?" CLINTON: "Well, what we did when I was Secretary of State, as I said, went above and beyond anything that was required, anything that any charitable organization has to do. Now obviously, if I am President, there will be some unique circumstances, and that's why the Foundation has laid out additional unprecedented steps that it would take, if I am elected." COOPER: "Didn't those unique circumstances exist…" CLINTON: "No, no look, Anderson, I know there is a lot of smoke, but there is no fire, put it in context. It excludes nearly 2,000 meetings I had with world leaders, plus countless other meetings with US government officials, when I was secretary of state, it looked at a small portion of my time, and it drew the conclusion, and made the suggestion that my meetings with people like the late great, Ellie Wiesel, or Melinda Gates, or the Nobel prize winner Mohammed Yunus, were somehow due to connections to the foundation, instead of their status as highly respected global leaders. That is absurd! These are people I was proud to meet with, that any Secretary of State would have been proud to meet with to hear about their work and their insights." Democrats And Editorial Boards Have Openly Criticized The Clinton Foundation

Joe Biden Said That Clinton Still Needs To "Figure Out" How To Handle The Clinton Foundation's Conflicts Of Interest. CNN'S JEFF ZELENY: "Does she need to do more explaining, on some of these controversies like email and these other things or should she stop explaining." VICE PRESIDENT JOE BIDEN: "Well I think she's uh, I, I, Tim, my understanding is that she is going to make final judgement of what they are going to do with the Foundation, and just lay it all out and this is what is going to happen from this point on, this is who I am, this is what I'm going to do, I think that will be good." ZELENY: "Has she not been clear enough?" BIDEN: "Well, it's it's been a moving target, I mean you look at the whole notion of how foundation's function, is now all of the sudden being put in play like it never was before, so I am absolutely confident she is doing it by the book, and I think she is gonna figure out what she's gonna say, crystal clear to the American people about the relationship between the family and the Foundation will be from this point forward." Sanders Has Taken Aim At The Clinton Foundation's Foreign Government Donations. CNN'S JAKE TAPPER: "You have not been critical of the Clinton Foundation, but there are those who say that there is something inherently wrong with an American charity, especially one with ties to a Secretary of State, taking money from the Saudis, and other foreign governments that don't represent our values. Is that a fair criticism?" SEN. BERNIE SANDERS (D-VT): "Yes, it is. If you ask me about the Clinton Foundation, do I have a problem, when a sitting Secretary of State and a Foundation ran by her husband collects many millions of dollars from foreign governments, governments which are dictatorships, you don't have a lot of civil liberties, or democratic rights in Saudi Arabia, you don't have a lot of respect there for opposition points, for gay rights, for women's rights, um yeah, do I have a problem with that? Yeah I do." TAPPER: "You think it creates an appearance of conflict of interest?" SANDERS: "Yeah, I do." (CNN's "State Of The Union," 6/5/16)

Clinton Ally And Former Pennsylvania Governor Ed Rendell (D) Said The Clinton Foundation Should "Disband" If Clinton Wins. "Former Pennsylvania Gov. Ed Rendell (D) said the Clinton Foundation should be disbanded if Democratic nominee Hillary Clinton is elected to the White House. 'I definitely think if she wins the presidency they have to disband it. I know it'll be hard for President (Bill) Clinton because he cares very deeply about what the foundation has done,' Rendell, a Clinton ally, told the New York Daily News." (Rebecca Savranksy, "Rendell: Clinton Foundation Should Be Disbanded If Clinton Wins," The Hill , 8/17/16)

  • Rendell Said That "It'd Be Impossible To Keep The Foundation Open Without At Least The Appearance Of A Problem." "'It'd be impossible to keep the foundation open without at least the appearance of a problem.' Rendell, who also served as a former chairman of the Democratic National Committee, said the Clinton Foundation would at least need to go into a 'period of inactivity' during Clinton's time in office if she were to be elected." (Rebecca Savranksy, "Rendell: Clinton Foundation Should Be Disbanded If Clinton Wins," The Hill , 8/17/16)

Dem Senator Cardin: Clinton Foundation "Clearly Needs To Change The Way They Do Business." FOX NEWS' SHANNON BREAM: "Let's talk about the fact that the Clinton foundation has been abuzz this week. There's been talk about a potential hack, potentially by Russian interests and there's been a statement by Bill Clinton that the foundation will no longer accept corporate money or foreign money if she's elected president. The Boston Globe said it should be shut down all together, it just creates a view of potential conflict of interest. They said in part, 'The inherent conflict of interest was obvious when Hillary Clinton became Secretary of State in 2009. She promised to maintain a separation between her official work and the foundation, but recently released emails written by staffers during her State Department tenure make clear that the supposed partition was far from impregnable.' They go on to say, listen, If the Foundation's donors are truly motivated by altruism, and not by the lure of access to the Clintons, then surely the can find other ways to support the Foundation's goals.' Do you think the foundation should shut down altogether?" SENATOR BEN CARDIN (D-MD): "First, let's recognize what the foundation has been able to do. The Clinton Foundation has been able to help millions of people, over 10 million HIV aids alone saved countless lives. Its work is extremely important to global health. They've done some really great things. Now with Hillary Clinton being elected president, which we hope it will be, they clearly need to change the way they do business. They've indicated they will. They're not going to accept any donations from foreign entities, they're going to change the way that the Clintons themselves interact with the foundation. Those decisions will be made appropriate to Hillary Clinton as president of the United States." (Fox News' " Fox News Sunday," 8/21/16)
