PRESIDENT TRUMP HAS THE RIGHT AND OBLIGATION TO FILL THE LATE JUSTICE RUTH BADER GINSBURG’S SEAT ON THE SUPREME COURT

The Constitution gives President Trump the ability to nominate a Supreme Court Justice, while the Senate has the power to appoint and approve the nominee.

There is nothing in the Constitution that prevents a Supreme Court vacancy from being filled, “regardless of how close to an election it opens up.”

Justice Ruth Bader Ginsberg herself argued that a President has the power to appoint judicial nominees as long as he is elected President.

The president is elected for four years not three years, so the power he has in year three continues into year four."

PRESIDENT TRUMP’S PICK, JUDGE AMY CONEY BARRETT, HAS BEEN WIDELY HERALDED AS BEYOND REPROACH

President Trump’s nominee, Judge Amy Coney Barrett, has been met with resounding praise, receiving support from legal experts across the ideological spectrum:

Six of Judge Barrett’s former law students wrote an Op-Ed in USA Today where they said, “while we vary about how to best interpret statutes and the Constitution, we agree on this: The nation could not ask for a more qualified candidate.”

ABC News on Judge Barrett: “She’s very well regarded, well liked, I don’t think anyone’s going to be able to raise issues about her qualifications.”

Ken Starr on Judge Barrett: “The President has chosen a superb nominee.”

George Stephanopoulos on Judge Barrett: “By all accounts she’s a brilliant lawyer.”

The Wall Street Journal Editorial Board: “Judge Barrett’s record and intellect suggest she can join Mr. Trump’s other appointees in reviving core constitutional principles in American law and life.”

Former dean of the Boston College Law School and president of the Catholic University of America, John Garvey: “I would be astonished if anyone were to oppose her nomination on the basis of character or intellect.”

DEMOCRATS, UNABLE TO WIN CONTROL OF THE WHITE HOUSE OR SENATE IN 2016 AND 2018, ARE SEEKING TO UNDERMINE REPUBLICAN-APPOINTED JUSTICES WITH A RADICAL COURT PACKING SCHEME 

Because they were unable to win control of the White House in 2016 or the Senate in both 2016 and 2018, Democrats have “few options to try to prevent President Donald Trump from confirming his nominee.”

Their “Hail Mary” play is this: Abandon a century of precedent and expand the number of Supreme Court Justices so they can install justices they feel would rule in their favor.

The idea is “relatively mainstream” within the Democrat Party.

Many top Democrats are receptive to the plan, with Senate Minority Leader Chuck Schumer saying, “nothing is off the table next year” should the Republicans fill Justice Ginsburg’s seat.

Joe Biden’s running mate, Sen. Kamala Harris (D-CA), supported the plan during the primary, warning that Democrats must do whatever it takes to avoid a looming “crisis” in the Supreme Court.

 Many Democrat house members including Rep. Jerry Nadler (D-CA) and Rep. Alexandria Ocasio Cortez (D-NY), who has long supported court-packing have come out in favor of the plan.

BIDEN HAS REPEATEDLY REFUSED TO ADDRESS DEMOCRATS PLAN TO PACK THE COURT, ADMITTING THAT HE DOES NOT WANT TO DRAW ATTENTION TO THE ISSUE

Biden has repeatedly “avoided giving a definitive answer” about his position since the plan has gained support following the death of Justice Ginsburg.

Biden has said outright that he will not answer what he admits is a “legitimate question” to avoid “shifting the focus” onto the court packing issue.

In this weeks debate, Biden again refused to say whether he supports packing the court in order to avoid drawing attention to the issue.

ITS UNSURPRISING BIDEN DOESN’T WANT PEOPLE PAYING ATTENTION, AS COURT PACKING IS UNPOPULAR ACROSS THE BOARD

It’s no surprise Biden wants to keep Democrat plans to pack the court quiet in the run up to election day, as the idea is widely unpopular; 54% of Americans oppose increasing the number of Supreme Court Justices.

Justice Ginsburg herself opposed the idea; in 2019, she told NPR that the plan would be very damaging to the court and the country.

Justice Ginsburg warned that expanding the court impairs the idea of an independent judiciary, and “if anything, would make the court look partisan.”
