WASHINGTON - Today, the Republican National Committee (RNC), North Carolina Republican Party (NCGOP), and the Clay County Republican Party Chair sued the North Carolina State Board of Elections (NCSBE) for its unlawful actions restricting party election observers and extending the delivery deadline for absentee ballots.
“The NCSBE continues to undermine the democratic process with unlawful rulemaking and further restrict the rights of election observers, threatening the integrity of our elections. This lawsuit is the latest development in the RNC and NCGOP's ongoing fight to preserve transparency in North Carolina elections and stop unelected bureaucrats from rewriting the law in the Tar Heel State.” – RNC Chairwoman Ronna McDaniel.
Background:
- The NCSBE unlawfully issued a regulation restricting the activities of certain party election observers in a way that directly conflicts with state election statutes.
- The NCSBE issued guidance that extended the absentee ballot delivery deadline until Monday, November 14, three days beyond the statutory deadline.
- The NCSBE continues to violate state law and the U.S. Constitution’s grant of authority to the state legislatures to enact laws governing federal election procedures -- and has a long history of doing so.
- This is the 60th legal action in this election cycle alone in which the RNC has engaged to protect the integrity of our elections. We will continue to litigate as necessary to preserve the integrity of our elections and stop unelected bureaucrats from rewriting the law.
