Important questions for KBJ

This week, Biden’s Supreme Court nominee Ketanji Brown Jackson will be questioned before the Senate. Concerning questions have been raised about her record and her judicial philosophy.

Here are just a few that Americans need answers to:

Jackson has a history of praising and defending critical race theory ideas and authors:

1. Would she rely on CRT “principles” in rulings? What role should CRT play in the American legal system?
2. Does she believe that Critical Race Theory is a legitimate academic discipline?
3. She cited CRT as playing a role in “fairness in sentencing”? What role is that?
4. What was she referring to when she cited CRT promoter Janet Bell’s “excellent insights”?
5. Has she read Derrick Bell’s book? When was it on her family’s coffee table?
6. What part of the 1619 Project does she agree with? Does she believe Nikole Hannah-Jones deserves “acclaim”?

Jackson has deviated from the federal sentencing guidelines in favor of the child porn offenders in every single case she has taken part in. This pattern, and some of the comments she has made, raise serious questions:

1. Does she believe the American judicial system is too harsh on sex offenders? Does she regret any sentence she gave a child predator that was less than the guidelines?
2. Should there by a minimum sentence for child sex predators? Is she still in favor of removing them?
3. What kind of person has child porn and is not a pedophile like she claimed?
4. Should child predators register as sex offenders? She seemed to suggest they shouldn’t because of “stigmatization and ostracism.”

Unlike her predecessors including Ruth Bader Ginsburg, Jackson has refused to endorse fundamental court principles and reject court packing. Will she embrace radical far-left efforts to politicize our institutions?

1. Does she support adding seats to the Supreme Court?
2. Does she support abolishing the electoral college?
3. Does she support a federal takeover of elections?

Jackson has given criminals a pass and showed a refusal to ensure enforcement of our immigration laws.

1. Does she believe American cities should divert funding away from police departments?
2. Why does she refuse to refer to immigrants who come to the U.S. illegally as illegal immigrants?
3. In 2019, Jackson wrote an opinion against the Trump administration that struck down a rule to expand the expedited removal process.  Does she stand by that ruling after it was quickly struck down by the D.C. Circuit court as judicial overreach?

Jackson has a history of attacking the First Amendment, including for pro-life groups.

1. Would she protect the free speech rights of pro-life groups?
   • In 2001, Jackson was part of an amicus brief filed by pro-choice advocacy groups that blocked the First Amendment rights of pro-life supporters near abortion clinics.
2. Would she force pro-life Americans to fund abortion providers with their tax dollars?
3. In 2018, Jackson ruled against President Trump’s attempt to defund Planned Parenthood by cutting $200 million in Title X family planning grants for abortion providers.
4. When Jackson clerked for Justice Stephen Breyer, Breyer authored a decision striking down a Nebraska law banning “partial-birth abortion.”
5. The vast majority of Americans oppose this horrific practice, which even Joe Biden previously voted to outlaw.
6. When Jackson clerked for Justice Stephen Breyer in 2000, Breyer was a part of the decision that decided that student led prayer would not be allowed at football games at public schools in New Mexico.
7. Does she believe the current federal partial-birth abortion ban is unconstitutional?
8. Can Americans pray at football games?

Joe Biden himself insisted questions like these must be asked because Supreme Court justices aren’t “bound by stare decisis” and can “make new law.” The hearings before the Senate are the perfect place to ask them. The American people deserve nothing less.
