What we know about how Ketanji Brown Jackson applies the law is very concerning, just look at how she approaches sentencing.
In 2015, Jackson gave two lectures about “fairness in sentencing” in which she said she tried to “convince” her students that sentencing is “interesting” because it “melds together myriad types of law,” including “critical race theory.”
What? CRT in sentencing? Sounds like KBJ is actively trying to insert CRT into American legal doctrine. It’s a worry made more acute by her praise of the debunked 1619 Project and Dr. Janet Dewart Bell. In a 2020 lecture, Jackson said she drew “heavily” from the “excellent insights” of Bell. For those unaware, Bell has vigorously defended CRT and compared the United States to the Holocaust and Nazi Germany.
And it’s not just CRT. As Senator Hawley pointed out, Jackson has called for removing mandatory minimum sentences for child porn, questioned making convicted child predators register as sex offenders, and said some who collect child porn are not actually pedophiles.
The result of Jackson’s sympathy? More lenient sentences for child predators. In one disturbing example, an offender “possessed thousands of images of child porn” and “hoped to travel across state lines to abuse a 9-year-old girl.” Sentencing guidelines called for 97-121 months behind bars. Jackson gave him just 57.
We know how KBJ has applied the law in the past, and it raises serious questions for how she would rule as a justice if confirmed.
